New ELD Waiver for Agriculture Transportation

Recently, the Federal Motor Carrier Safety Administration (FMCSA) announced more steps to address the unique needs of the agriculture industry in the United States with the newly mandated electronic logging devices (ELDs).

This is in addition to the previous ELD extension that was provided to drivers in the agricultural industry. If you are one of these drivers, then please keep reading to learn how the FMCSA is working to help you and your important work down below.

Agriculture Transportation ELD Help

A 90-day temporary waiver from the ELD rule for agriculture-related transportation has been issued for the public interest. The waiver will provide the FMCSA additional time to complete its analysis of responses from the 2017 public forums.

Right now, the 150 air-mile rule allows the transportation of agricultural products within a 150 air-mile radius, or 172 road miles, without requiring an ELD in the truck.

However, the rule is considered quite complicated. From initial processing of the public responses, the agency has learned that the agricultural industry is more complex than others in the transportation field, so additional time is needed to find solutions for continued problems.

Plus, the FMCSA will continue outreach to provide assistance for professionals in the agricultural industry regarding the ELD rule.

Do Not Forget

Beginning April 1, 2018, full enforcement of the ELD rule will begin. Meaning, carriers will be subjected to FMCSA regulations and will be put out-of-service if they don’t have the required ELDs. If caught without ELDs, drivers will remain out-of-service for 10 hours. While the driver will be allowed to travel to the next scheduled stop, they should not be dispatched without an ELD. Further action will be taken the next time the driver gets caught without an ELD.
