The FMCSA Extends Certain Comment Periods

The Federal Motor Carrier Safety Administration (FMCSA) has issued several alternative proposals to modify existing guidelines for drivers based on the new ELD mandate. They have also decided to extend the accompanying comment periods for both alterations.

The Hours-of-Service Exemption for Ag Haulers

According to current regulations, ag haulers who drive within the 150 air-mile radius of the source of their products are exempt from maintaining records of duty status.

In December 2017, the FMCSA proposed an expansion for the 150 air-mile radius hours-of-service exemption for livestock and ag haulers. This would potentially exempt ag haulers driving an unloaded vehicle on their way to pick up a load, after their delivery, and while the truck is in transit.

While the FMCSA originally provided a 30-day comment period, they have now extended it until February 20th. If you are in the agriculture industry or another industry stakeholder, consider voicing your comments.

New Personal Conveyance Guidelines

Also in December, the FMCSA proposed an alteration to the personal conveyance guidelines.

This change would remove the requirement that commercial motor vehicles must be unladen before they can be used for personal conveyance. Therefore, truckers would be allowed to use their CMVs for personal conveyance, even if they are carrying load-related materials.
