The ELD Mandate Starts Today

Today, December 18th, is the day that the ELD mandate goes into effect.

All motor carriers and drivers must follow the ELD rules by using an ELD or grandfathered AOBRD by today. On December 16, 2019, AOBRD will be phased out and you must use self-certified ELDs that are registered with the FMCSA. Key Requirements

To make sure that you are clear on what the ELD mandate will begin enforcing today, here are the key requirements:

1. All commercial drivers must have ELDs installed in their trucks to record their hours-of-service record of duty status.

2. There are strict ELD performance and design standards to regulate ELD technology. All ELDs must also be certified and registered by every ELD provider.

3. Every driver and carrier must have the designated supporting documents inside their vehicles at all times; paper logs and ELD user manual.

4. There can be no harassment of drivers by their company, based on ELD data or connected technology. There will be proper solutions in place for drivers who believe they have, in fact, been harassed.

Who Must Comply with The ELD Mandate?

The ELD regulations apply to almost every carrier and driver who is currently required to maintain records of duty status. This applies to all commercial vehicles, as well as those who are domiciled in Canada and Mexico.

Limited exemptions to this mandate include:

  • Drivers who operate under the short-haul exceptions can use time cards, not ELDs.
  • Drivers who use paper RODS for less than 8 days out of every 30-day period.
  • Drivers who conduct drive-away-tow-away operations.
  • Drivers of vehicles with engines manufactured before 2000.

If these exceptions do not apply to you, then yes, you must strictly follow the ELD rule in order to be operating legally.

ELD Enforcement

If you are still not prepared for ELD, it is important to note that there will be an introductory period where you will not be put out of service if you don’t have an ELD. However, you can still be cited and fined if you get caught. The introductory period ends April 1, 2018.

However, it is probably in your best interest to get compliant as quickly as possible. Don’t cost you or your business unnecessary fines that could potentially put you out of business. Save yourself the stress and hassle, and you will have an easier transition into the ELD-governed system.
